Let’s Finally Finish Off the Academy of Dietetics’ Nonsense Law

I am not intentionally picking on Registered dieticians (RD’s) and the  Academy of Nutrition and Dietetics (AND), formally known as the American Dietetics Association.  But folks, low hanging fruit is low hanging fruit. 

The AND claims it is “the world’s largest organization of food and nutritional professionals.”  Somehow, this cartel believes that only its members should be legally allowed to give nutritional advice.  If anyone violates their laws, the AND would command that fire and plagues rain down on the miscreants who dare speak their mind about nutrition.  I have written to you about this before in previous blogs. In fact, the AND cartel tried to pass a law in most states mandating that only licensed Registered Dieticians can speak to the public about food and nutrition.  In Michigan, the law was passed in 2006 and signed by the Governor.  This law would make it a crime for anyone who is not licensed to give nutritional advice.  Of course, the law was written so that the only ones licensed would be RD’s.  Remember, in my previous blogs I wrote to you that the RD’s have little practical training in nutrition.  (http://drdavidbrownstein.blogspot.com/2010_09_01_archive.html)

Thank goodness, the 2006 law was never fully implemented.  Now, there is a new bill to repeal the Michigan Dietetics/Nutrition Law that has been introduced—HB 4688.  The sponsor is Rep. The Michigan Academy of Nutrition and Dietetics recently held their annual conference at Grand Valley State University, April 25-26, 2013.  Guess who were the Gold Sponsors?  McDonalds and Michigansoybean.org paid for that honor.   With Gold sponsors like those, why shouldn’t RD’s be the only licensed group allowed to speak about nutrition?  (That previous sentence was stated with sarcasm.) 

Before the RD hate mail begins, keep in mind not all RD’s are clueless about nutrition.  I have met some very intelligent RD’s who work hard learning the truth about nutrition.  I guarantee you that each of the nutritionally-knowledgeable RD’s learned nearly all of what they truly needed to know outside of their AND training.

Final Thoughts:  It is ludicrous to limit nutritional guidance to a group (AND and RD’s) that has little or no nutritional knowledge.  This law should be repealed in Michigan as well as in every other state where it was passed.  To fight the AND’s legal nonsense, the Center for Nutrition Advocacy was set up.  You can access them here:   http://www.nutritionadvocacy.org/michigan.

    Hello,

    I am a Registered Dietitian and work in clinical nutrition. From my experience, I was fortunate to have a very comprehensive education including a masters degree in nutrition. However, I am not a member of the Academy and I do not agree with many of the published research papers we RDs are supposed to cite and follow as part of our practice. It really depends on who is publishing the research study (what companies are endosing them) and what kind of information or misinformation they would like to convey in order to make money. I have met many clueless RDs as well as nutrition mocking MDs. I think that in order to understand the complex nature of our physical human condition, we need to also understand our physical environment, what we have done to our soil and food and the increasing amount of stress we put on oursleves. I think it is time for RDs, MDs, holistic health practioners to come together and change the way our “health” system operates. We all share responsibilty for this planet as well as the health and well being of each other.

    A Doctor of Chiropractic typically has much more training in nutrition than a typical MD or DO. That being said, anyone giving nutritional advice needs to constantly study, attend conferences, and use online teleconferences to acquire and maintain an adequate level of competency. It is up to the consumer to decide if the advice they receive, no matter the source (with a degree or not), is right for them. I too, in my 35 years of practice, have seen many patients who have received the most outrageous advice from professional as well as lay “experts”. In response to Kristin, no one has “failed to thrive” by a trial of gluten, dairy, soy, or dirty vegetables. I would agree that vegetarianism should be undertaken with great care and perhaps under the care of a physician or at least with regular testing for nutrient deficiencies.
    It appears that the law was sponsored by the large corporate interests who don’t want the public to take matters of health into their own hands. They want a monopoly by their proxy AND.
    I am not writing this response in my own self interest as all physicians, be they DO, MD, or DC, are not affected one way or the other by this law.
    We are not talking about prescribing toxic medications or performing surgery, practices that are clearly overdone here in the US It sounds like you would have Physical Therapists outlaw trainers, Psychotherapists outlaw support groups,

    I am a Registered Dietitian in Michigan. Also, I am a Certified Clinical Nutritionist and have extensive training in Functional Medicine. This training has come primarily from advanced nutrition practitioners such as Chiropractors, Naturopaths, Pharmacists, Nurses, Nutritionists, Dentists, MDs, DOs, and well trained RDs, all experts in Functional Medicine.

    I do not support the licensure law. Registered Dietitians (RD) are simply not prepared academically or through training to handle the complexity of chronic disease. Our education is fundamental at best, and only requires a BS degree. The ADA/AND primarily focuses on institutional dietetics, food service management, and broad public health concerns.

    I have a private practice. Countless patients have come to me who have already seen RDs, and the stories about their dissatisfaction are always the same. Their experiences were that the RDs couldn’t answer or dismissed many of their questions about diet and supplements, and that they were just given “cookie-cutter” handouts. They felt it was a waste of time and money. These patients had complex chronic disease, and the RDs they saw did not have the skill set to understand or treat these conditions.
    The good thing is that many RDs refer patients to me and come to me as patients themselves. Dietetic students from all over the country call me to inquire about what education and training paths to take to become practitioners of Functional Medicine.
    Like Dr. Brownstein says, there are many progressive and likable RDs!

    It is a change in the right direction that in Illinois (home state ADA/AND), 3 new nutrition certifications have been included in their licensure law (CCN, CNS, DACBN), even though the RDs opposed it. And just this week, the Governor of Indiana vetoed the dietetics licensure law.

    The Michigan licensure law does not protect the public. It protecst one trade association, the Michigan Dietetic Association. And do you want a state association that has McDonalds as their “gold sponsor” in charge of a law that supposedly protects the public? The fox guarding the hen house?

    I believe there is a misunderstanding on what is and isn’t covered by that law. Anyone can discuss general health and wellness related to nutrition. But with the licensure laws, this dictates that a licensed professional (Registered Dietitian) who has a fundamental knowledge base in nutrition and disease, as well as the training to ascertain credible information from the many “studies” that are available may discuss nutrition as a therapy for disease. As a professional who has had several patients, including children with failure to thrive because a chiropractor, or health food store employee gave them advice not to eat dairy, gluten, soy, meat, “dirty vegetables” or any other trigger term of the day, I stand by that law.

    It’s laughable that people with meaningless credentials from corrupt organizations want to outlaw their competition–for the benefit of the public, I’m sure.

    I believe a registered dietitian is given a framework to build upon that can not be replaced by a nutritionist with a high school diploma. A Bachelor of Science should be a pre-requisite prior to offering nutrition advice. Nutrition is complex.

    Integrative Medicine doctors had to earn the MD before specializing in holistic care. MDs take a lot of money from big Pharma. How is it any different for the Academy to accept money from a large food sponsor?

    Should anyone be able to offer medical advice- without an MD, DO or ND credential?
    What is the difference?!

      Thanks for commenting. I agree that nutrition is complex. It would be nice if MD’s and RD’s were appropriately trained in the science of nutrition. But, the reality is that neither group has received an appropriate education that allows either MD’s or RD’s to be the sole licensed group allowed to speak about nutrition.
      I have seen many nutritionally intelligent RN’s, ND’s, CCN’s, acupuncturists, message therapists, and even health food store workers and owners. Many of these people know a lot about nutrition. I have also seen many (too many) nutritionally clueless MD’s and RD’s. Just having a degree does not bestow nutritional knowledge, especially when that school has an inherent bias against nutritional therapies. And, both MD and RD schools are totally biased against nutritional therapies.

      I say, let the public decide. If they want to spend their money getting nutritional advice from someone, so be it. If they don’t get their money’s worth, then they can move on to someone else.
      And, we are not talking about medical advice here.

      MD’s do take a lot of money from Big Pharma. That is why much of the research sponsored by Big Pharma is biased. If you don’t think a similar thing will happen to RD’s, then I might have some swamp land to sell you. I could care less of the Academy of Dietetics accepts money from McDonalds, et al. However, if the Academy does take their money, then their credibility as a nutritionally-oriented institution is instantly shot.
      If you want to be taken seriously as a nutritional organization, then I don’t think it is wise to be taking money from Big Food Companies that manufacture toxic food products that are making us sick and fat. Similarly, it is not wise for the American Heart Association to accept money from tobacco companies.

    Yes, I am an RD, but I will say I have learned more about dietetics through personal research, attending Broda Barnes conferences, and through an alternative doctor than my so-called degree. I feel the degree was from a crack-jack box (pun intended) compared to what I know now. I cannot even belong to the AND because of where the money comes from and goes to. It is sad when my profession has been sold to these major drug– I mean– food companies. This is one more RD who stands by you Dr.Brownstein, and I hope many of my fellow RD’s will also come around and find out who is really pulling the strings.

    I would have liked to have seen RN in other specialties on your list that give nutritional advice. I am a Nurse in chronic disease management and a certified Diabetic educator. What I do for a living is give nutritional advice and I am not a nurse practitioner but a Registered Nurse.

      I did not mean to imply that RN’s could not give dietary advice. In fact, I have no problem with a nutritionally-oriented RN giving dietary advice. My problem is with the law that mandates only RD’s can give nutritional advice.

    I couldn’t agree with you more. In my opinion the sponsors of this group are the reason why we are dealing with the health crisis we have today and people have the right to know what they are consuming and then make a decision for themselves what to eat. I teach bio-individuality and I am not beholden to any food manufacturer as they (RD’s) are. I do agree, there are some who do know a lot about nutrition but in my recent visit to our local hospital I was floored with the diets and the drink offerings that were being presented to people who are already sick. This ridiculous law must be repealed.
